ADDDITIONAL INSTRUCTIONS FOR SECOND SIMON EXERCISE

Each firm will have 20 minutes for a follow-up meeting with Simon which takes place the day before the scheduled administrative hearing.

Two firm members have been given confidential lawyer instructions. The instructor will select one of these students to take the lead during the meeting, but the two students will conduct the meeting as partiners. They are permitted to take a break during the meeting to consult and they may decide that the other student will take over completion of the meeting.

Three firm members have been given confidential client instructions. The instructor will select one of these students to play the role of the Simon. The other two students are responsible for taking notes of the meeting; one will also serve as time keeper. The student who is not keeping time will prepare a draft memo summarizing the meeting and circulate that memo to the other four members of the firm in time to get their feedback. A final memo representing the work of the entire firm must be emailed by the time keeper student to the instructor by noon on Tuesday, March 24.

This exercise requires both careful and thoughtful preparation and close attention during the exercise itself. The firm grade of 0-3 will be based on the instructor's observation as the instructor circulates among the firms during the exercise and the accuracy and completeness of the memo summarizing the meeting.
